What kind of inquiry is management science? This paper compares two accounts — realist-oriented and constructivist-oriented — and proposes a third position. The realist view that scientific inquiry seeks knowledge of realities independent and outside of the knowing process is set against the constructivist view that scientific theorising creates accounts which develop our discourses without claiming knowledge of ‘deeper’ realities. It argues that ultimately we have no way of resolving this long-standing dispute. To move beyond the impasse it proposes a (...) trusting constructivist position, arguing that responsible theorising requires that inquirers develop discursive accountability and that the process of inquiry matters as much as its content. Finally it explores what such a view of accountability would mean for the relationship between scientists or ‘professionals’ and users of their research findings in organisations. (shrink)

En la Universidad Médica “Carlos J. Finlay”, se realiza una intervención educativa con el objetivo de valorar la concepción y aplicación de un programa para un curso de preparación de metodólogos en correspondencia con sus funciones en condiciones de universalización de las Ciencias Médicas de Camagüey, en el periodo de septiembre de 2005 a junio de 2007. Se emplean diferentes métodos investigativos: los teóricos, así como la técnica de discusión grupal, permitió diseñar el programa del curso para la preparación de (...) metodólogos en condiciones de universalización y los empíricos, la obtención de algunos datos de interés acerca de los metodólogos que reciben el curso y sus valoraciones en relación con el mismo. Se constata que la preparación pedagógica y experiencia en el desempeño es insuficiente para asumir el rol de metodólogo y valoran de muy importantes los contenidos desarrollados, los métodos y formas organizativas concebidas, por lo que se concluye que el programa del curso cumple con las expectativas del metodólogo al estar diseñado teniendo en cuenta las funciones que estos desempeñan y sus necesidades sentidas A study was carried out about the intervention in education developed to increase teacher's methodological preparation under their new functions due to the fresh conditions of learning within the community applied to medicine training and education in Camagüey. It was carried out in the period of September 2005 to June 2007. Different research methods were used: the theoretical ones and the technique for group discussion help to design the course syllabus and the assessment for those teachers that received the course. It was verified that the methodological preparation and performance experience are insufficient to play their role; but they value as very important the contents, the methods and the organization of the course. The authors conclude that the course meets the expectations of training, because it was designed keeping in mind the teachers' functions and their necessities. (shrink)

El trabajo ofrece una reconstrucción de aquello que la dogmática del derecho penal denomina una “tentativa inacabada”, cuya estructura es analizada a partir de premisas obtenidas de la filosofía de la acción. El argumento se centra en demostrar por qué y cómo la así llamada “resolución-al-hecho”, en cuanto presupuesto de tal forma de tentativa, ha de ser caracterizada como una intención previa, a través de cuya formación el agente adquiere el compromiso práctico de ejecutar u omitir una acción de cierta (...) índole. El objetivo así perseguido consiste en identificar las condiciones de las cuales depende que una tentativa inacabada pueda ser constitutiva de un quebrantamiento de la misma norma quebrantada por el autor del respectivo delito consumado. Las normas del Derecho Internacional Humanitario establecen límites al uso de los medios y métodos de combate en el desarrollo de las hostilidades. Si bien en su origen el DIH no fue elaborado teniendo en cuenta los desafíos planteados por el desarrollo de la inteligencia artificial en ese contexto, es una realidad que en la actualidad la evolución de esta inteligencia, los algoritmos y su aplicación militar emergente constituyen un desafío a la luz de las normas humanitarias. Ese desafío comprende (...) tres ámbitos fundamentales: el técnico, el legal y el ético. Si bien se puede decir que la IA, en la etapa actual de desarrollo, permite que un programa computerizado basado en algoritmos realice ciertas tareas en un entorno complejo e incierto, a menudo con mayor precisión que los seres humanos, también debemos destacar que no hay tecnología que haga que una máquina se comporte como un ser humano, quien puede determinar si una acción es lícita o ilícita y decidir no continuar con lo programado, teniendo como objetivo primordial la protección de las víctimas. Los Estados deben adoptar regímenes de verificación, prueba y monitoreo como parte del proceso para determinar e imponer limitaciones o prohibiciones de acuerdo a los principios esenciales de distinción y proporcionalidad que el DIH establece en la utilización de armas durante los conflictos armados internacionales o no internacionales. Tanto desde una perspectiva legal como ética el ser humano está en el centro de esta problemática, ya que la responsabilidad por el uso de la fuerza no puede transferirse a sistemas de armas o algoritmos, y sigue siendo una responsabilidad humana. El objeto principal de este trabajo consiste en discutir una propuesta de C. Alchourrón y A. Martino para hacer frente al problema de la fundamentación de la lógica deóntica, planteado por el dilema de Jørgensen. La propuesta criticada se basa en la idea de que no existe obstáculo alguno en compatibilizar la idea de que las normas carecen de valor de verdad con la idea de que poseen una lógica, una vez que se renuncia al "prejuicio filosófico" de que es (...) indispensable caracterizar semánticamente las relaciones y propiedades lógicas y se explica la lógica a partir de la noción abstracta de consecuencia, desligándola de las nociones de verdad y falsedad. Sostienen que el significado de los operadores deónticos, al igual que el de los términos lógicos en la deducción natural, puede quedar totalmente expresado una vez que se explicita su uso mediante reglas de introducción y eliminación. Para ilustrar su propuesta, pretenden ofrecer una fundamentación puramente sintáctica de la lógica deóntica standard. Mis críticas se centran en tres puntos: a) no utilizan auténticas reglas de introducción para los operadores deónticos; b) no derivan la lógica deóntica standard como pretenden haber hecho, y c) no se establecen criterios para relacionar las fórmulas del cálculo con el lenguaje normativo ordinario, con lo que no existen razones para considerar que se trata de una lógica deóntica. Defiendo la idea de que, a los fines de fundamentar semánticamente la lógica deóntica, sólo es necesario que existan interpretaciones admisibles que atribuyan valores de verdad a las normas, y que este requisito es cumplido por la semántica usual de la lógica deóntica standard, con lo que el dilema de Jørgensen resulta ser un seudoproblema. In this paper I discuss a proposal from C. Alchourrón and A. Martino with which they try to face the problem posed to the foundation of deontic logic by Jørgensen' s dilemma. Their proposal is based on the idea that there is no problem at all in compatibilizing the fact that norms lack truth values with their possession of a logic, once it is denied that it is absolutely necessary to offer a semantic characterization of logical properties and relations, and the abstract notion of consequence is taken as primitive. They claim that the meaning of deontic operators, like that of logical terms in natural deduction, is completely expressed through their use, which is explained by means of rules of introduction and elimination. As an illustration, they present a calculus with which they intend to offer a foundation for standard deontic logic. I make three objections: a) They don' t use real rules of introduction for deontic operators; b) They don' t have derived standard deontic logic as they claim; c) There are no criteria for relating the formulas with ordinary normative discourse; so there are no reasons for considering their calculus as a deontic logic. I claim that, in order to give a semantical foundation to deontic logic it is only necessary that there are admissible interpretations that assign truth values to norms, and that this requisite is satisfied by the usual semantic of standard deontic logic. I conclude that Jørgensen' s dilemma is a pseudoproblem. (shrink)

No obstante, en el ámbito moral, sigue manteniendo una luz de la naturaleza, ínsita em los hombres, que es recta norma para la razón., para quienes buscan conocetrla. De todos modos, que da establecido, con el empirismo de Locke, que explicar el conocimiento de una cosa implica explicar el origen que el hombre tiene de esse conocimiento, revalidando el valor de la investigación humana y de la historicidad del conocimiento. Tradicionalmente, las discusiones acerca del análisis correcto del concepto de justificación epistémica se han centrado en la justificación de creencias. Este artículo sugiere que hay una correlación filosóficamente interesante entre las nociones de ‘justificación epistémica’ y de ‘práctica’. Se argumenta que, con base en tres conocidos argumentos wittgensteinianos (el del regreso infinito de reglas, cl de la subdeterminación de las reglas por las regularidades observadas y contra el lenguaje privado), es posible mostrar la relevancia de las prácticas para Ja evaluación (...) epistemica -algo que mina la utilidad dei reduccionismo tradicional para la epistemología.Traditionally the discussion concerning the correct analysis of the concept of epistemic justification has centered on the justification of beliefs. This paper suggest that there is a philosophically interesting correlation among the notions of ‘epistemic justification’ and ‘practices’. I argue that based on three well-known wittgensteinian arguments (the infinite return of rules, the subdeterminacióon of the rules by observed regularities, and against the private language) it is possible to show the relevance of practices for epistemic evaluation - something which undermines the usefulness of traditional reductionism to epistemology. There is a growing interest in how people conceptualise the legal domain for the purpose of legal knowledge systems. In this paper we discuss four such conceptualisations (referred to as ontologies): McCarty's language for legal discourse, Stamper's norma formalism, Valente's functional ontology of law, and the ontology of Van Kralingen and Visser. We present criteria for a comparison of the ontologies and discuss the strengths and weaknesses of the ontologies in relation to these criteria. Moreover, we critically review the (...) criteria. Con el objeto de dar cuenta de la dinámica del derecho, Alchourrón y Bulygin distinguen los conceptos de sistema jurídico y de orden jurídico. El primero hace referencia a un conjunto de enunciados que contiene todas sus consecuencias deductivas, entre las cuales hay normas cuyo contenido son actos coactivos. Se trata de una entidad estática. El orden jurídico, por su parte, es concebido como una secuencia de sistemas jurídicos enlazados por algún criterio de legalidad o validez, y conserva su identidad (...) a través de los cambios producidos por la sanción o derogación de normas. Es mi propósito presentar argumentos tendientes a sostener que la noción de orden jurídico no es adecuada para los fines que se propone y, además, su postulación, con el sentido que le atribuyen los autores, resulta innecesaria. Aiming to account for the dynamic nature of law, the Argentinian philosophers Carlos Alchourrón and Eugenio Bulygin discriminate the concepts of legal system and legal order. The first makes reference to a set of statements that includes all their deductive consequences, among which there are norms that prescribe coercive acts. It is a static entity. legal order, on the other hand, is conceived as a sequence of legal systems connected by some criterion of legal validity and keeps its identity through the changes produced by the passing or abrogation of laws. The aim of this paper is to present arguments leading to support that the notion of legal order is inadequate for its declared purpose and, furthermore, its conception, with the meaning the authors assign to it, is unnecessary. Se realiza una revisión bibliográfica con el objetivo de analizar los diferentes códigos éticos y deontológicos internacionales, regionales y nacionales de los que se nutre la especialidad de psiquiatría. Se concluye que el comportamiento ético se basa en el sentido de la responsabilidad individual de cada psiquiatra hacia cada paciente y en la capacidad de ambos para determinar cuál es la conducta correcta y más apropiada. Las normas externas y las directrices, tales como los códigos de conducta profesional, las aportaciones (...) de la ética y de las normas legales, no garantizan por sí solas la práctica ética de la medicina, pero constituyen un importante marco referencial. A literature review was performed with the objective of analyzing the various international, regional and national ethical and deontological codes that the psychiatry specialty feeds on. It is concluded that ethical behavior is based on the sense of individual responsibility of each psychiatrist to each patient and the ability of both to determine what the correct and appropriate behavior is. External standards and guidelines, such as professional codes of conduct, the study of ethics and legal standards alone do not guarantee the ethical practice of medicine but are an important framework. This article studies one specific aspect of two of the most important contemporary ethical theories for the rational foundation of morals norms: R. M. Hare's universal prescriptivism, and the discursive ethics of the German philosopher Karl- Otto Apel. In this way, and bearing in mind the necessity of always establishing a mediation between the universal ethics of principles, and the concrete historical contexts of the communities which apply the aforementioned norms, this last question is studied in the theories of both (...) philosophers. In Hare's case, besides the inherent difficulty of the formalism he adopts, he cannot account for the problems indicated, inasmuch as, on the one hand, the incorporation of the utilitarianism that he proposes for this request is not justified and, on the other hand, with the method of interpersonal transferences, it is difficult to get to know the people's desires and interests, because of the impossibility of putting oneself in the other's place. As regards Apel, although he proposes a more coherent thesis, he does not in fact appropriately take into account the problems of the justification of decisions, and of the application of principles to historical situations. All these issues, pose the necessity of considering the feasibility of complementation with Habermas 's conception of discursive ethics.En este artículo se analiza un aspecto específico de dos de las más importantes teorías éticas contemporáneas para la fundamentación racional de las normas morales: el prescriptivismo universal de R.M. Hare, y la ética discursiva del filósofo alemán Karl- Otto Apel. Teniendo en cuenta la necesidad de establecer siempre una mediación entre la ética universal de principios, y los contextos históricos concretos de las comunidades que aplican dichas normas, se aborda esta última cuestión en las teorías de ambos filósofos. En el caso de Hare, además de la dificultad propia del formalismo que adopta, no puede dar cuenta de los problemas en cuestión en la medida en que, por un lado, la incorporación del utilitarismo que para este requerimiento propone no está justificada y, por el otro lado, con el procedimiento de las transferencias interpersonales es difícil conocer los deseos e intereses de las personas por la imposibilidad de ocupar el lugar del otro. En relación con Apel, el autor considera que, aunque propone una tesis más coherente, en realidad no tiene en cuenta adecuadamente los problemas de justificación de las decisiones y de la aplicación de los principios en las situaciones históricas. Lo antes mencionado plantea la necesidad de considerar la viabilidad de complementación con la concepción habermasiana de la ética discursiva. (shrink)

H. L. A. Hart’s The Concept of Law (Hart 1994) contains many passages that have become iconic for legal theory. This essay focuses on Chapter 7, sections 1 and 2, and Hart’s comments about judicial discretion in the context of Ronald Dworkin’s well-known attack on the idea of judicial discretion in his essay “The Model of Rules”. Specifically, the paper undertakes three projects. The first project is to defend the importance of the fundamental picture that Hart presents in Concept, Chapter (...) 7 of Common-Law judicial rule-making. Hart represents such rule-making as a balance of certainty and flexibility, and he is correct to do that. The second project is to argue that Dworkin’s attack on the positivist model of common-law judicial rule-making as an exercise of “strong discretion” fails. The idea, central to the meaning of “strong discretion” that courts are not “not bound by standards set by the authority in question” cannot be established. The third is to argue that Hart is his own worst enemy. The language, metaphors and images he uses to present his account of common-law judicial rule-making open the way to Dworkin’s critique. They also reveal Hart, if the language, metaphors and images are taken seriously, to be precisely the kind of formalist or deductivist about adjudication that he is ostensibly in Concept Chapter 7 criticising.Resumen:El concepto de derecho (1994) de H. L. A. Hart, contiene muchos pasajes que se han convertido en íconos de la teoría jurídica. Este artículo se concentra en el capítulo 7, sección 1 y 2, y en los comentarios que realizara Hart sobre la discreción judicial en el contexto de la bien conocida crítica de Dworkin a esta misma idea en su ensayo “El modelo de las normas”. Específicamente, el artículo emprende tres proyectos. El primero de ellos consiste en defender la importancia del esquema fundamental que ofrece Hart en el capítulo 7 de su obra, esto es, la creación judicial de normas en el Common Law. Hart representa tal creación de normas como un balance de certeza y flexibilidad; y él está en lo correcto al presentarlo de tal modo. El segundo proyecto consiste en argumentar que la crítica de Dworkin al modelo positivista de la creación judicial de normas en el Common Law, como un ejercicio de “discreción fuerte”, no está sustentada. La idea —central para el significado de “discreción fuerte”— de que los tribunales no están “sujetos a criterios establecidos por la autoridad en cuestión” no puede ser establecida. El tercer proyecto consiste en argumentar que Hart es su peor enemigo. El lenguaje, las metáforas e imágenes que emplea para exponer su teoría de la creación judicial de normas en el Common Law abre la puerta a la crítica dworkiniana. Si tomamos en serio el lenguaje, las metáforas y las imágenes, encontraremos a un Hart del tipo formalista o deductivista sobre la adjudicación, justo como el que él mismo está abiertamente cuestionando en el capítulo 7 de El concepto. John Searle's Speech Acts (1969) and Expression and Meaning (1979) developed a highly original and influential approach to the study of language. But behind both works lay the assumption that the philosophy of language is in the end a branch of the philosophy of the mind: speech acts are forms of human action and represent just one example of the mind's capacity to relate the human organism to the world. The present book is concerned with these biologically fundamental capacities, and, (...) though third in the sequence, in effect it provides the philosophical foundations for the other two. Intentionality is taken to be the crucial mental phenomenon, and its analysis involves wide-ranging discussions of perception, action, causation, meaning, and reference. This article explores various conceptions of Nietzsche’s thoughts on autonomy. It distinguishes six main interpretive approaches, each with its own conception of autonomy: autonomy as spontaneous self-determination, in the sense of traditional free will; a “standard model” interpretation counting actions as autonomous when they are caused by rationalizing beliefs and desires; a view that traces autonomy to a Kantian transcendental subject; constitutivist theories that seek to explain the source of normativity by “deriving ethics from action”; “hierarchical model” interpretations arguing that (...) complex, higher-order attitudes “speak for the agent,” and thereby constitute her autonomy; and conceptions of autonomy as an ethical ideal. Divine temporality is all the rage in certain theological circles today. Some even suggesting that the doctrine of the Trinity entails divine temporality. While I find this claim a bit strong, I do think that divine temporality can be quite useful for developing a robust model of the Trinity. However, not everyone agrees with this. Paul Helm has offered an objection to the so-called Oxford school of divine temporality based on the Christian doctrine of the Trinity. He has argued that (...) this form of divine temporality entails Arianism. In other words, divine temporality suffers from an inadequate doctrine of the Trinity. In this paper I shall first articulate the so-called Oxford school of divine temporality. From there I shall develop some of the Oxford school’s theological benefits that help flesh out the doctrine of the Trinity, and assuage the charge of Arianism. Then I shall offer an examination and refutation of the Arian charge to divine temporality in order to show that the divine temporalist can maintain a robust Trinitarian theology. (shrink)

Aunque la bioética surgió en un contexto de investigación biomédica y del ejercicio de las ciencias de la salud, no se limitó a este ámbito. V. R. Potter propuso una bioética global, en la cual el medio ambiente debía ser también protagonista. Una de las tareas fundamentales de la bioética, desde sus orígenes, es devolverle al ejercicio de la medicina el componente humano que los desarrollos biotecnológicos amenazan con erosionar. La bioética debe servir también para reconciliar al ser humano consigo (...) mismo, con los demás y con el medio ambiente del que forma parte, pues lo interviene y modifica con un saldo negativo para la naturaleza. Otro cometido principal de la bioética consiste en contribuir al reconocimiento del valor de la vida humana y fortalecer una cultura de la vida, frente a los desafíos que plantean los conflictos armados e intereses economicistas. Para alcanzar estos objetivos, es indispensable contar con un adecuado respaldo biojurídico, del que son especialmente garantes los cuerpos legislativos, quienes tienen una precisa y clara responsabilidad para legislar en conformidad con la Constitución Política de los Estados. Es crucial que las nuevas generaciones adquieran, desde tempranas edades, conceptos, hábitos y actitudes que garanticen una sabiduría de vida reflejada en la cotidianidad. Esta sabiduría debe articular bienes, virtudes y normas que garanticen la convivencia humana y la consolidación de sociedades justas, solidarias y verdaderamente libres. (shrink)

According to the logical pluralism of Beall and Restall, there are several distinct relations of logical consequence. Some critics argue that logical pluralism suffers from what I call the collapse problem: that despite its intention to articulate a radically pluralistic doctrine about logic, the view unintentionally collapses into logical monism. In this paper, I propose a contextualist resolution of the collapse problem. This clarifies the mechanism responsible for a plurality of logics and handles the motivating data better than the original (...) view. It is a major improvement that should be embraced by all logical pluralists. (shrink)

This full-length study of Plato's dialogue Phaedrus, now in paperback, is written in the belief that such concerted scrutiny of a single dialogue is an important part of the project of understanding Plato so far as possible 'from the inside' - of gaining a feel for the man's philosophy. The focus of this account is on how the resources both of persuasive myth and of formal argument, for all that Plato sets them in strong contrast, nevertheless complement and reinforce each (...) other in his philosophy. Not only is the dialogue in its formal structure a dovetail of myth and argument, but the philosophic life that it praises is also shaped by an acknowledgement of the limitations of argument and the importance of mythical understanding. Starting from an historical remark of R. Tuch (1993) concerning the relationship between Renaissance scepticism and the first social contract theories, this article defends the idea that the main difference between Hobbes's social contract theory and contemporary contractualism rests on the conception of reason. Comparing Hobbes and Rawls it shows that the first one rejects subjective theories of rationality and conceives the contract as a pre-condition of successfid individual rationality, which allows him both to escape sceptical and relativist criticisms and (...) to consider politics as an autonomous source of norms. /// Apoiando-se numa observação historica de R. Tuck (1993) acerca das relações entre o cepticismo saído do Renascimento e as primeiras teorias do contrato social, o presente artigo defende a tese de que a diferença fundamental entre a teoria hobbesiana do contrato e o contratualismo contemporâneo versa sobre a concepção da razão. Comparando Hobbes e Rawls acerca do contrato, o autor mostra até que ponto o filósofo de Malmsbury rejeita as teorias subjectivas da racionalidade fazendo do contrato a precondição para o exercício individual da razão, o que lhe permite simultaneamente evitar as críticas cépticas e relativistas e de considerar a política como uma fonte autónoma de normas. In a series of papers, Thomas P. Flint has posited that God the Son could become incarnate in any human person as long as certain conditions are met (Flint 2001a, 2001b). In a recent paper, he has argued that all saved human persons will one day become incarnated by the Son (Flint 2011). Flint claims that this is motivated by a combination of Molinism and orthodox Christology. I shall argue that this is unmotivated because it is condemned by orthodox Christology. (...) Flint has unknowingly articulated a version of the heresy called Origenism that is condemned by the Fifth Ecumenical Council. After arguing that Flint’s account is unmotivated because it is condemned, I shall offer some reflections and prolegomena on the relationship between contemporary analytic theology and the ecumenical creeds. In this article, we critically scrutinize the principle of proportionality when used in the context of security and government surveillance. We argue that McMahan’s distinction from just warfare between narrow proportionality and wide proportionality can generally apply to the context of surveillance. We argue that narrow proportionality applies more or less directly to cases in which the surveilled is liable and that the wide proportionality principle applies to cases characterized by ‘collateral intrusion’. We argue, however, that a more demanding criterion (...) than the lesser-evil justification that wide proportionality frequently entails is necessary in cases characterized by intentional intrusion upon non-liable individuals. The distinction between foreseeing and intending intrusion into the lives of individuals who are not liable has not previously been specifically addressed in discussions concerning surveillance ethics. This specification is thus increasingly important due to the general growing tendency for adherence to the precautionary principle and policies aimed at anticipating criminal acts before they are committed. Preventive surveillance of non-liable actors is considered an important instrument for obtaining this aim and thus calls for moral scrutiny in terms of permissibility and proportionality. We suggest the concept ‘wide proportionality +’ which applies to cases of intentional intrusion of non-liable individuals. (shrink)

This essay deals with property rights in body parts that can be exchanged in a market. The inquiry arises in the following context. With some exceptions, the laws of many countries permit only the donation, not the sale, of body parts. Yet for some years there has existed a shortage of body parts for transplantation and other medical uses. It might then appear that if more sales were legally permitted, the supply of body parts would increase, because people would have (...) more incentive to sell than they currently have to donate. To allow sales is to recognize property rights in body parts. To allow sales, however, makes body parts into “commodities”—that is, things that can be bought and sold in a market. And some view it as morally objectionable to treat body parts as commodities. (shrink)

Scholars and practitioners across domains are increasingly concerned with algorithmic transparency and opacity, interrogating the values and assumptions embedded in automated, black-boxed systems, particularly in user-generated content platforms. I report from an ethnography of infrastructure in Wikipedia to discuss an often understudied aspect of this topic: the local, contextual, learned expertise involved in participating in a highly automated social–technical environment. Today, the organizational culture of Wikipedia is deeply intertwined with various data-driven algorithmic systems, which Wikipedians rely on to help manage (...) and govern the “anyone can edit” encyclopedia at a massive scale. These bots, scripts, tools, plugins, and dashboards make Wikipedia more efficient for those who know how to work with them, but like all organizational culture, newcomers must learn them if they want to fully participate. I illustrate how cultural and organizational expertise is enacted around algorithmic agents by discussing two autoethnographic vignettes, which relate my personal experience as a veteran in Wikipedia. I present thick descriptions of how governance and gatekeeping practices are articulated through and in alignment with these automated infrastructures. Over the past 15 years, Wikipedian veterans and administrators have made specific decisions to support administrative and editorial workflows with automation in particular ways and not others. I use these cases of Wikipedia’s bot-supported bureaucracy to discuss several issues in the fields of critical algorithms studies; critical data studies; and fairness, accountability, and transparency in machine learning—most principally arguing that scholarship and practice must go beyond trying to “open up the black box” of such systems and also examine sociocultural processes like newcomer socialization. Cost conversations are essential to informed consent because patients have a right to information that they think is relevant, and patients overwhelmingly report that cost information is relevant to their medical decisions. Providers have an ethical responsibility to provide necessary information for informed consent, and therefore must discuss costs. The Shared Decision Making model is ideal for enabling this exchange of information, and decision aids are also helpful. Although barriers exist, many useful tools can help providers fulfill this obligation, and (...) encouraging progress is being made to improve cost transparency from insurers and facilities. The dominance of capitalism, through the hegemony of neoliberal ideology, is maintained as an illusion through the use of four main strategies. In order to obtain the consent of the population, mass schooling tends to produce graduates who accept this illusion because they are vulnerable to these strategies and cannot imagine a post-capitalist world. However, through education, people can better appreciate the problematic reality of unbridled capitalism, such as the degradation of the global ecosystem. It is argued here that programs (...) which are designed to address these problems, such as Education for Sustainable Development, are dependent upon citizens developing a critical consciousness. This consciousness is firstly able to confront the four strategies maintaining capitalism’s dominance. It is argued that an education which engages with spiritual ideals and values regarding how a good life is understood in an aspirational sense, enables people to engage with the dominance of capitalism and to envision other possibilities for society in which capitalism is harnessed to serve the greater public good. This requires education’s ontology – as the character of students – to critically read the world, imagine possibilities which can constitute a good life, and are courageous to enact the social actions required to make these ideals a reality. This is made possible by an education which returns to the spiritual roots of ideals. (shrink)

ABSTRACT The Scottish judge and ‘eccentric’ philosopher James Burnett, Lord Monboddo’s (1714–1799) significance within Enlightenment thought is usually seen as stemming from his Origin and Progress of Language (6 vols., 1773–1792). The OPL was a major contribution to the Enlightenment’s debate over the philosophy of language, and established Monboddo’s reputation as an innovative and influential, yet controversial and credulous proto-anthropologist. In the following I explore Monboddo’s Egyptomania and the role it plays in his account of the origins and development of (...) religion within his larger ‘History of Man’. Monboddo’s idiosyncratic and untimely fusion of conjectural history, Buffon-inspired natural history, Christian theology, Platonic and Aristotelian philosophy and credulous interest in Egyptology, especially in Antient Metaphysics (6 vols., 1779–1799), make him extremely difficult to place within the Scottish Enlightenment. I want to bring Monboddo back into our conversation about the Scottish Enlightenment, shed light in the process on his highly idiosyncratic combination of enlightened and unenlightened thought and, using Monboddo’s example, emphasize some interesting if unexpected aspects of the Scottish Enlightenment’s application of the ‘science of human nature’ to the study of religion. For Monboddo, human civilization and religious knowledge owes their existence to Egyptian daemon-kings. (shrink)

The Patient Preference Predictor (PPP) is intended to improve treatment decision making for incapacitated patients. The PPP would collect information about the treatment preferences of people with different demographic and other characteristics. It could be used to indicate which treatment option an individual patient would be most likely to prefer, based on data about the preferences of people who resemble the patient. The PPP could be incorporated into existing US law governing treatment for incapacitated patients, although it is unclear whether (...) it would be classified as evidence of a specific patient’s preferences or those of a reasonable person sharing certain characteristics with the patient. Ethical concerns about the quality and significance of PPP choices could influence legal decision makers’ views of the PPP. (shrink)

When someone sees one of us busily scribbling formulas or structures, he or she has no trouble identifying a chemist. The neural basis of human memory is incredibly complex. We argue that the diversity of neural systems underlying various forms of memory suggests that any discussion of enhancing ‘memory’ per se is too broad, thus obfuscating the biopolitical debate about human enhancement. Memory can be differentiated into at least four major systems with largely dissociable neural substrates. We outline each system, and discuss both the practical and the ethical implications of these diverse neural substrates. In practice, distinct neural bases imply (...) the possibility, and likely the necessity, of specific approaches for the safe and effective enhancement of various memory systems. In the debate over the ethical and social implications of enhancement technologies, this fine-grained perspective clarifies—and may partially mitigate—certain common concerns in enhancement debates, including issues related to safety, fairness, coercion, and authenticity. While many researchers certainly appreciate the neurobiological complexity of memory, the political debate tends to revolve around a monolithic one-size-fits-all conception. The overall project—exploring how human enhancement technologies affect society – stands to benefit from a deeper appreciation of memory’s neurobiological diversity. (shrink)

It is argued, in this paper, that moral theories should not be discussed extensively when teaching applied ethics. First, it is argued that, students are either presented with a large amount of information regarding the various subtle distinctions and the nuances of the theory and, as a result, the students simply fail to take it in or, alternatively, the students are presented with a simplified caricature of the theory, in which case the students may understand the information they are given, (...) but what they have understood is of little or no value because it is merely a caricature of a theory. Second, there is a methodological problem with appealing to moral theories to solve particular issues in applied ethics. An analogy with science is appealed to. In physics there is a hope that we could discover a unified theory of everything. But this is, of course, a hugely ambitious project, and much harder than, for example, finding a theory of motion. If the physicist wants to understand motion, he should try to do so directly. We would think he was particularly misguided if he thought that, to answer this question, he first needed to construct a unified theory of everything. (shrink)
